Lenovo is a global brand known for manufacturing computers, entertainment devices and gaming accessories. A few years ago, the tech giant was banned in Germany after courts ruled that the company had violated the patent rights of American company InterDigital. As a result, the Munich court ended up banning Lenovo from selling certain products in Germany, at least for a while.
Lenovo owns Motorola and different products come under different brands. Motorola makes smartphones, for devices like the Moto G and Motorola Edge, while Lenovo produces laptops, computers and monitors – and Lenovo laptops are known to last a while. In May 2024, Lenovo and Motorola were both found to have infringed a pending patent for InterDigital’s 4G and 5G networks. The court ruled that all devices manufactured by Lenovo and using a 4G and 5G network would be banned from sale in Germany. It all has to do with FRAND – fair, reasonable and non-discriminatory patent commitments. The court found that InterDigital had acted in accordance with FRAND standards for its networks and said those rights were violated by Lenovo when the company failed to act in accordance with FRAND standards.
This network included all models with WWAN technology sold by Lenovo. InterDigital also claims that Lenovo also did not agree to the licensing fees for the patent. This ban never happened in the United States, as no cases were ever raised. If this case had been brought before the US courts, a temporary ban could have taken place, as there is precedent for this. It’s unclear why no cases have been brought before a U.S. court, but one potential reason is that Lenovo is used by hundreds of government and military agencies, and a total ban would result in a complex situation. However, an American company wants to ban Samsung’s foldable devices.
Germany’s Lenovo ban didn’t last long
When the first legal proceedings first took place in May 2024, there was a lot of talk about counterfeiting and patents. Court records indicate that Lenovo had little or no interest in providing a fair solution for both itself and InterDigital. Instead, Lenovo continued to negotiate to improve its own position on the matter, thereby delaying the possibility of reaching an agreement.
The court rejected Lenovo’s argument that the company had effectively made a FRAND bid for a 5G license by offering royalties as determined by the UK High Court the previous year. The delay in reaching an agreement on payment to InterDigital was seen as a resistance tactic by Lenovo. However, even though negotiations did not take place during the initial proceedings in May, Lenovo and InterDigital reached a new patent licensing agreement five months later. The new agreement allowed Lenovo and InterDigital to settle all previous disputes between the two in October 2024, and the temporary ban was lifted. Not much more was said about the agreements reached or the amount paid between the two companies.
Why foreign technology is banned in the United States
The technology is banned for several reasons. Whether as in the case between Lenovo and InterDigital over patents and negotiations, or for political reasons related to the control of foreign goods, as is the case with the United States which has banned routers manufactured abroad. The US government has also implemented strict bans on Nvidia and its high-end computer chips. The ban ends all shipments of chips to China. However, even though exports are tightly controlled, Chinese technology companies have found ways to use them from neighboring countries like Thailand. The reason for the ban would be to better control the production of the chips, as they are needed for AI data centers. That and U.S. government leaders say it’s aimed at preventing China from training AI using U.S.-made computer chips.
At the same time, in Europe, Chinese smartphones are selling quite well and represent one in three smartphones sold. Although smartphone sales are doing well overseas, on U.S. soil there are political tensions between Chinese tech companies and the U.S. government that make it difficult to obtain some devices.
